1. No liability can be accepted for equipment or data whilst in the possession ofARC iT Solutions. We will, of course, take the best possible care of the above wherever possible.
2. All work will be carried out on the understanding that all data has been previously backed up by the customer to a separate media disk.ARC iT Solutions will not accept liability for any loss of data. We will be happy to undertake this work and provide a back up of your system, however we would have to apply a charge for this work.
3. Unless otherwise stated, all invoices are payable on presentation.
4. All equipment including parts and data remain the property of ARC iT Solutions until the invoice is settled in full and maybe removed until the invoice is finally settled.
5. No compensation will be available for any delay or rescheduling, however we will always do our very best to avoid any delays.
6. All information on the site is subject to change.
7. The "No repair, No Fee" policy applies only to problems that ARC iT Solutions are technically unable to fix and not due to the unwillingness of the customer to purchase the necessary parts or labour required to fix the problem.
Please make sure you are happy with our terms and conditions before ordering. The terms are structured and latter stages apply to broadband and internet service customers. You will be required to tick a box ‘accepting our terms and conditions' at the time of ordering.

General / Orders
- Any prices contained in a quote can only be guaranteed for 30 days.
- If the needs or requirements of the client change or differ from their original description then we reserve the right to re-quote for the new description.
- Our prices may be subject to changes from time to time and it is therefore recommended that (to be sure of a price) a firm quote is obtained, or that a customer has the most recent price list. This can be obtained on our web-site or directly using the contact details below.
- ARC iT Ltd reserves the right to refuse any order.
General / Payment
- Any order may require a full or 50% deposit and in some circumstances a signed agreement
- Certain services require full payment up front, and others will be invoiced
- Invoices should be paid in full within 7 days of the invoice being issued.
Web-Site Packages
- Any free additional services are for the first year only and therefore would involve an annual recurring fee should a customer continue to use that service. The customer is given the opportunity to cancel before the service is billed.
- The minimum that any web-site will require after the first year is web-hosting that ARC iT Ltd is a provider of.
Web-Hosting
- In some instances Stanway.net may need to reject an order for hosting and recommend a personal server if the web-site due to be hosted has particularly high traffic. This is to optimise the performance of the site and other sites on our service. ARC iT Ltd reserves the right to use our discression when considering an order.
- Any form of adult material may not be hosted by ARC iT Ltd
- All web-sites based on our servers are the responsibility of that particular web-site owner. ARC iT Ltd accepts no liability for any of the content on the web-sites and reserves the right to take action should server space be used inproperly.
- Although it is our aim, an aim which we have achieved thus far, We cannot guarentee 100% Up times for web-sites hosted with ARC iT Ltd and you must appreciate times of maintenance and error may possibly occur. You understand ARC iT Ltd cannot and does not accept any liability for loss of sales or any other loss due to your web-site not being online at a particular time. No hosting fees can be refunded due to a site being offline.
E-mail Services
- When a spam filter is installed, it is up to the user to set the filter level on the individual control panel. The filter may not prevent all spam and if set too high, the filter may stop some regular mail. To prevent this, add as many trusted e-mail addresses as possible to the allowed list on the control panel.
- ARC iT Ltd cannot give a 100% guarantee that not a single virus will ever pass through our virus scan. Our supplier has the latest virus technology and updates to prevent all known viruses and potential viruses, so the chance of receiving a virus through your e-mail is very small indeed. It will not prevent other methods that viruses may use to enter your computer (through instant messaging, shareware download, other e-mail addresses etc) and we would recommend to every computer that you have a virus scanner installed.
Domain Hosting
- A domain is required to be attached to the Stanway.net server in order to host a web-site. This can be done by Stanway.net registering the domain on your behalf or details of how to attach a domain to web-space (using DNS tags) can be made available on request.
- Once registered by ARC iT Ltd, if a domain is required to move from our servers within the registration period then it may be subject to a £30 release fee or £20 redirection fee for administration purposes, as are the time requirements to sort it out. Alternatively a customer could re-purchase the domain once the domain becomes available again, after it's registration period ceases.
Search Engines
- To guarantee submission to as many search engines as possible, a web-site must follow editorial and technical guidelines that can be made available on request. ARC iT Ltd will always design web-sites in accordance to these guidelines to the best of our ability.
- Search Engine submission simply means your web-site is available on search engines. It does not guarantee a web-site to be top of every search engine. However, Weekly reports can inform you of how your web-site is doing on search engines using specific keyword searches.
- ARC iT Ltd can never guarentee any positions on search engines.
ARC iT Broadband & Services User Terms & Conditions
SCHEDULE 1
Schedule of Services
- Rental of ADSL on existing BT analogue line from customer's site (BT analogue line rental still payable)
- IP connectivity between customer's site andARC iT's Internet Network service.
- IP addresses may be requested atARC iT's discretion and subject to completing an appropriate IP Address request form. Where IP addresses are issued these must be returned upon termination of this agreement and are at no time the property of the Customer.
- The customers are expected to manage their own hardware. ARC iT will not provide any support for hardware or configurations. It is the customer's responsibility to ensure the hardware is compatible with the service.
- ARC iT Broadband has the right to refuse any order without reason.
SCHEDULE 2
Charges
All charges are payable as per the order form and in advance. Setup fees and one month (plus part month where applicable) service will be paid with the initial invoice.
Prices are subject to change at any time and 30 days notice will be given for an price increases. Our latest prices can be found on ARC iTbroadband.com. This price list does not necessarily display our most recent prices.
VAT is not added to our prices at present. Customers will be given 30 days notice should this circumstance change. Customers on a 12 month contract will have their bills adjusted to ensure that no higher price is paid until the end of the term out of goodwill should they not be VAT registered.
The term of the monthly rolling contract agreement is initially 1 month with 30 days written notice to cancel. Termination of this agreement within the minimum term will incur a cancellation fee of 100% of any remaining charges for the rest of the minimum term.
SCHEDULE 3
Service Standards
- On wires only, ARC iT Broadband only provides support for the service being provided on a working BT analogue line.
- In order to use ADSL Services, you need an existing BT telephone line and a personal computer of a minimum specification. You acknowledge that we are dependent upon certain third parties to install and provide ADSL Services to you. You also acknowledge that there may be technical limits that prevent us from delivering an operational service to you. We will endeavour to provide ADSL Services to you at the access rate you choose but, due to contention within the network, the speed of service may be reduced at times.
ARC iT Broadband is only responsible for the hardware and service up to the Ethernet interfaces, all equipment and services beyond this are the customer's responsibility. - We do not undertake to provide a fault free service. If, however, a fault occurs, you should report the fault by electronic mail or in writing to the Support Service. We will let you know as soon as reasonably practicable of any periods of downtime of the Support Service.
Service Credits
- Do not apply to ARC iT Broadband Standard Care ADSL services. Network Premium includes Enhanced Care - if the qualifying fault isn't repaired within 24 hours, you may claim a service level credit within 30 days of the end of the month in which you reported the fault.
Outages
- Planned Outages may occasionally be necessary for ARC iT to carry out essential maintenance or network upgrades. They will be kept to a minimum and scheduled to minimise disruption.
- ARC iT Broadband will provide a fault reporting helpdesk facility. The helpdesk will respond promptly to faults reported. Faults remedied will be advised by email.
- ARC iT aims to rectify faults within 5 hours of raising a fault. Time to fix may be affected by circumstances. This is a target repair time and does not constitute a service level, under no circumstance is ARC iT liable for outages or consequential losses.
- Faults not involvingARC iT's Network services or equipment. ARC iT will advise of steps taken to diagnose a fault for which ARC iT is not responsible.
- Neither party shall be liable to the other, either in contract, tort (including negligence) or otherwise for direct or indirect loss of profits, business or anticipated savings, nor for any indirect or consequential loss or damage or for any destruction of data.

ARC iT Broadband Acceptable Use Policy
Introduction
The following Policy contains rules that govern your use ofARC iT's services (“Service”) and forms part of the terms and conditions of use of the Service.
This Policy may be amended from time to time and the most up to date version can be found on ARC iT.
Applying the Policy According to the Nature ofARC iT's Service to You
Depending upon the nature of the Service you have selected:
- you may be setting up website or websites to be run on either your server or our server ("Website");
- you may be using our hardware, software, network and / or telecommunications to use the Service ("Our Equipment")
- you may be providing your own hardware, software, network and / or telecommunications to use the Service ("Your Equipment")
This Policy applies to all of the Services you select.
Restrictions on the Service
You are not permitted to have illegal material on your Website(s), link to content that is illegal or to allow Our Equipment or Your Equipment to be used for any illegal activity. You risk being prosecuted if you or any of your customers publish illegal material in this or any other country.
You must ensure that your Website(s), Our Equipment and Your Equipment are not used to incite disorder, publish, disseminate or promote any material which encourages anything which is in any way pornographic, obscene, defamatory, menacing, offensive or in any way unlawful.
Neither you nor your shared users are permitted to publish any content, or link to any content, in which you or they (as applicable) do not own the right, without the prior permission of the owner of the relevant right.
You must not use or allow any of your Websites, Our Equipment or Your Equipment to be used to transmit or post any material which may cause offence to others on the grounds of gender, race or religion or which may cause annoyance or offence to any person.
ARC iT will comply with our obligations under the Data Protection Act 1998 and other any applicable data protection legislation. You are also required to comply with all data protection legislation. In addition, you must maintain all required registrations, including those reasonably requested by us to enable us to process your personal data in connection with our performance of our obligations under this Agreement.
Unacceptable Activities
You must not use or allow any of your Websites, Our Equipment or Your Equipment to be used to distribute or promote any of the following:
- the sending of unsolicited emails or forged messages or spoofing
- software which may be used for port-scanning, virus creation, packet sniffing, smurfing, hacking, Trojan horses or any other illegal or anti-social activity
- any activity which interferes with systems or networks' ability to operate including denial of service attacks in any form
- lists of email addresses (unless all of the addressees on the list have given their explicit permission)
- the processing of personal data which does not comply with all applicable data protection and privacy laws and regulations
- links to any website(s) that host illegal content
- content designed to offend or cause needless anxiety to others
Security
You must not do anything, or allow any third party to do anything, which will compromise the security of ARC iT's equipment and you are therefore required to install and use appropriate virus checking software and security devices and to impose this same requirement on any of your other users that use any of your Websites or Your Equipment.
You must not share, or disclose to any third party, any passwords provided by ARC iT. Such passwords are your responsibility.
